Terms of Service

These Terms of Service ("Terms") govern your use of Vinyl Portfolio (the "app", "service"), operated by Max Rosenthal. By creating an account or using the app, you agree to these Terms. If you don't agree, please don't use the app.

1. Eligibility

You must be at least 13 years old to use Vinyl Portfolio. By using the app you represent that you meet this requirement and that the information you provide is accurate.

2. Your Account

You are responsible for safeguarding the credentials you use to access the app and for any activity that happens under your account. Notify us promptly at support@vinylportfolio.com if you suspect unauthorized use. You may delete your account at any time from inside the app; see our Privacy Policy for what happens to your data on deletion.

3. Your Content

3.1 Ownership

You retain ownership of the records, photos, notes, and other content you add to your collection ("Your Content"). We don't claim any ownership of Your Content.

3.2 License you grant us

To operate the app, you grant Vinyl Portfolio a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display Your Content solely as necessary to provide the service to you. This license ends when you delete the relevant content or your account.

3.3 Public sharing

If you choose to make your collection visible to other Vinyl Portfolio users, you also grant a license to display the visible portion of Your Content to those users. You can change visibility at any time.

5. Subscriptions and Payments

Some features ("Pro" features) may be offered through paid subscriptions processed by Apple's App Store. Subscription terms — including pricing, renewal cadence, and trial periods — are presented at the point of purchase and are governed by the App Store's standard terms in addition to these Terms. You can cancel any subscription at any time from your Apple ID settings; cancellation takes effect at the end of the current billing period.

6. Third-Party Data

The app displays metadata, pricing estimates, and marketplace data from third-party sources (Discogs, eBay, MusicBrainz, and others). This data is provided for informational purposes only. We do not warrant the accuracy, completeness, or current applicability of any third-party data and we are not responsible for transactions you enter into based on it.

7. Termination

You may stop using the app at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the service. On termination, the license you granted us in Section 3.2 ends, and we'll delete your data per the schedule described in our Privacy Policy.

8. Disclaimer of Warranties

The app is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that the app will be uninterrupted, error-free, or that any pricing data, recommendations, or identification results will be accurate.

9. Limitation of Liability

To the fullest extent permitted by law, Vinyl Portfolio and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising out of or related to your use of the app — even if we have been advised of the possibility of such damages. Our total aggregate liability for any claims related to the app shall not exceed the greater of the amount you paid us in the twelve months before the claim arose, or fifty US dollars ($50).

10. Indemnification

You agree to indemnify and hold harmless Vinyl Portfolio and its operator from any claims, damages, or expenses arising out of Your Content, your violation of these Terms, or your violation of any third-party rights.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. Any dispute arising out of or related to these Terms or the app shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

12. Changes to These Terms

We may update these Terms as the app evolves. When we make a change that meaningfully affects your rights, we'll post the updated Terms here with a new effective date and notify users via the app or email when material changes occur. Your continued use of the app after the effective date means you accept the updated Terms.
